ELDER ABUSE

WHAT IS ELDER ABUSE?

Elder abuse is a serious issue that many individuals over the age of 65 years old suffer from in silence.  You may have legal action if you are being abused in any way or feel afraid or controlled by another person and any one or more of the following have occurred:

  • PHYSICAL ABUSE

    • Injury, bruises, scratches, use unnecessary restraints or medication​.

  • FINANCIAL ABUSE

    • Signs may include unusual bank account activity, unpaid bills, changes in spending patterns paired with a new good friend.​

  • MENTAL or EMOTIONAL ABUSE

    • Isolation, deprivation of things that are enjoyed (such as going outside, walks, phone privileges, etc.), or restricted contact with loved ones​

    • Actions taken have caused fear of harm

  • NEGLECT

    • Bad hygiene, bed sores, lack of shelter, dirty clothes, untreated medical conditions, preventing medical attention, malnutrition, or dehydration

The abuse can be caused by anyone from a spouse to a caregiver to a family member to a neighbor.  There are ways of stopping the abuse through legal action which can result in a Restraining Order.

WHAT CAN A RESTRAINING ORDER DO?

A restraining order will prevent the restrained person from:

  • Contacting you

  • Going near you

  • Living with you in your house

  • Owning a gun

WHO CAN APPLY FOR AN ELDER ABUSE RESTRAINING ORDER?

Any person over the age of 65+ who is suffering the abuse or the following persons:

  • Conservator or trustee of the adult

  • Attorney-in-fact

  • Any other person with the legal authorization
