HOW DOES A DPA WORK?
This document gives your designated attorney-in-fact power to control your personal property and finances. Your attorney-in-fact will be your agent and the personal representative who could run your business, pay your bills and taxes, control your stock, manage your real and personal property, etc.

The attorney-in-fact has a fiduciary duty to make any and all actions under the Durable Power of Attorney solely for your best interest. If the attorney-in-fact acts in bad faith and self-deals, you are protected because there are legal repercussions for which the attorney-in-fact can be held financially liable.

The purpose of this document is to prevent your loved ones from having to go to court to obtain a conservatorship over your estate should you ever become unable to handle your own affairs.
